Non-market redispatching of energy from renewable sources has become one of the key challenges facing the Polish energy sector, reducing the profitability of investments and generating measurable losses for generators. This phenomenon – relatively new and associated with the dynamic growth of installed capacity – has prompted the President of the Office of Competition and Consumer Protection (UOKiK) to support efforts to regulate the principles governing its application to ensure a level playing field, whilst simultaneously requiring the modernisation and digitalisation of the grid for improved energy flow management.

The issue of non-market redispatch of electricity from renewable energy sources is an increasing concern, affecting the profitability and development of the RES sector in Poland. As a result of forced production curtailments, producers are incurring significant financial losses, prompting them to explore legal avenues for claiming compensation.

The planned abolition of the 10H rule may soon become a reality. The draft of the new Wind Power Investment Law, adopted by the Polish Council of Ministers, has reached the Sejm, where further legislative work is underway. It is estimated that the proposed changes will make it possible to carry out wind investments in an area 26% larger than before - it is therefore an opportune moment to take care of solid and well-thought-out lease contracts.
