Mobbing and discrimination - a dedicated product offering in the area of labour law

46% of office and blue-collar employees are victims of mobbing, which entails an increase in the number of legal proceedings against employers in recent years. To the disadvantage of employers, only one in four respondents has admitted that the organization has undertaken any steps to counteract mobbing and discrimination, despite the obligations in this regard imposed by the Labour Code. The implementation of appropriate procedures and training of employees and co-workers in advance can significantly reduce the risks and frequency of discrimination and mobbing and improve the management of crisis situations in this area, which, in connection with the upcoming legal changes concerning the so-called whistleblowers, may be even more after 17 December.

In response to clients expectations in these areas, we have developed a dedicated product offer, based on independent modules, flexibly adjusted to the needs and capabilities of the organization.

Module 1

Evaluation of the current practices and procedures in the field of counteracting mobbing and discrimination and introduction of necessary changes in regulations binding in the organization:

  • information meeting with the Client;
  • analysis of internal regulations implemented in the organization so far (e.g. work regulations, remuneration regulations, and the Company Social Benefits Fund - if there is one);
  • proposal of necessary changes in the content of internal regulations;
  • implementation of the aforementioned changes and training for the HR department on how to respond to cases of possible notifications.

Module 1 will enable the organization to:

  • efficient management of difficult situations in the organization;
  • safe reporting of difficult situations by employees;
  • effective and efficient defense of employer's rights in disputes with employees;
  • fulfil the obligation imposed by law.

  • for organizations employing primarily under simple employment contracts

Module 2

It covers Module 1 and the implementation of additional, separate regulations related to the prevention of mobbing and discriminatory practices:

  • information meeting with the Client;
  • analysis of the internal regulations implemented in the organization so far (e.g. work regulations, remuneration regulations and the Company Social Benefits Fund - if there is one);
  • proposal of necessary changes in the content of internal regulations;
  • implementation of the aforementioned changes and training for the HR department on how to respond to cases of possible notifications;
  • development and implementation of the so-called Anti-Mobbing Policy;
  • development and implementation of the so-called Code of Ethical Principles;
  • training for middle and senior management on how to respond to signs and reports of mobbing and discrimination;
  • implementation or adaptation of a whistleblower protection proceedings.

Module 2 will enable the organization to:

  • efficient management of difficult situations in the organization;
  • safe reporting of difficult situations by employees;
  • effective and efficient defense of employer's rights in disputes with employees;
  • introduction of acts regulating the procedure of proceeding in case of mobbing or discrimination;
  • introducing a catalogue of rules of conduct and behavior for employees in the organization;
  • acquiring managers trained in how to consciously react in difficult situations;
  • introducing a modern system of reporting irregularities in the organization and protecting whistleblowers;
  • fulfilling obligations imposed by legal regulations.
